Legal Aspects of Urban Green Areas Planning

Abstract
Urban green areas has important and various functions what is known for a long time. In a post-war period a lot of publications came out in this field and presented in the literaturę theoretical aspects remained actual to a large extent till now. Before transformation there existed rules regulating designing of green areas in housing parts of cities. During last few years, especially after Polands accession to the EU, issues of environmental protection became much morę significant what was reflected in legislative changes. However, overview of current regulations shows, that problems of creating urban green areas is often treated as not so important, though it is strictly connected with environmental protection. There are still no regulations referring to the adaptation of environmental protection idea into spatial planning, including regulations being a legal foundation for creating urban green areas. Planning of these areas is based mainly on local authorities’ will as well as on designers’ knowledge. However, in current conditions this support is too poor, therefore regulations are needed which would normalise the process of urban green areas designing and which would be in force while preparing documents in the field of spatial planning.
