On the possibilities of recruiting minors as confidential personal sources of information

Abstract

The Polish legislator has not regulated in any way the possibility of police
cooperation with minors as confidential personal sources of information. Therefore, for many
years there have been opinions about the lack of legal obstacles to such cooperation.
However, it is forgotten that it may entail numerous risks for minors and the decision of the
legislator is rather a result of lack of awareness of the difficult choices that may face, for
example, police officers working on criminal groups. It is necessary to give a
broader presentation of our own perspective on this issue, based both on practical experience,
as well as resulting from an in-depth analysis of constitutional, national acts and
international agreements. All of those allowe to formulate a number of postulates that
will make it easier for police services to act within the limits of the law.
